Valentin Tataritsky: “The interaction of the Commission with the EAEU Court contributes to the improvement of the practice of uniform application of technical regulations of the Union”

At the plenary session of the International Conference of the EAEU Court, Minister for Technical Regulation of the Eurasian Economic Commission Valentin Tataritsky spoke about the main normative innovations in the Eurasian Economic Union in the field of standardization, conformity assessment and accreditation.

The EEC Minister expressed confidence that the legal instrument for updating product safety requirements and their orientation to progressive international standards will fully work in the Union from 2025. This will contribute not only to improving the competitiveness and export potential of a wide range of goods, but also to “weeding out” imported goods with reduced consumer characteristics from the EAEU market.

 

“Product requirements are changing rapidly, so it is important to keep abreast and monitor that the Union requirements for products do not lag behind in scientific and technical terms and do not slow down the industry of the Union countries in development,– the EEC Minister stressed. – In addition to the already existing Procedure for conducting a mandatory periodic assessment of the scientific and technical level of the Union’s technical regulations and lists of standards that have entered into force, an appropriate Action Plan has been prepared for the upcoming five-year period. It will affect 29 technical regulations of the Union and lists of standards for them.”

 

The Minister touched upon the new decisions of the EAEU to eliminate legal gaps in the field of conformity assessment and accreditation, aimed, inter alia, at preventing the activities of unscrupulous certification bodies and testing laboratories.

Using the example of the application of certain norms of the technical regulations on the safety of wheeled vehicles (TR CU 018/2011), Valentin Tataritsky stressed the need for closer cooperation with the EAEU Court to improve the mechanism for ensuring a uniform approach to the application of union technical regulations.

In the context of the increasing number of requests and appeals received by the Commission in relation to the field of technical regulation, Valentin Tataritsky drew attention to the fact that in the countries of the Union there remain differences in approaches to the implementation of certain norms of Standard Conformity Assessment Schemes, on the basis of which assessment procedures are established directly in the technical regulations of the Union (in particular paragraph 124 of the Standard Schemes).

 

“The Commission intends to apply to the Court of the Union for clarification on the issue of the competence of the supervisory authorities of one member state to demand from applicants or certification bodies of another member state documents on the basis of which certificates of conformity were issued or declarations of compliance with the requirements of technical regulations were adopted,” the EEC Minister said. – The relevant request was received by the Commission from the Ministry of Emergency Situations of Belarus. And the opinions of the authorized bodies of the Union countries on this appeal differed. The Commission expects that the relevant Advisory Opinion of the Court will contribute to the uniform application of such a norm of Standard Conformity Assessment Schemes in the countries of the Union.”

The EEC Minister urged his colleagues to maintain the vector of deepening integration and developing high-quality and progressive solutions when developing legal acts.

 

“Using the example of the formation of an action plan for the Declaration on the Further Development of the Union until 2030 and for the period up to 2045, we see a different level of readiness of countries for more serious measures. Including in terms of deepening integration in various areas and adjusting national competencies in favor of supranational ones in this regard,” the EEC Minister stressed. – When planning such long-term prospects, we simply have to go beyond the scope of current work and concentrate our efforts on larger things. And ten years of experience in the conditions of our integration is a solid foundation for our further development.”
