The Parliament of Kazakhstan will adopt laws faster: deputies approved new regulations

ASTANA, Sputnik reports. The deputies of the Senate and the Majilis of Kazakhstan at a joint meeting adopted amendments and additions to the regulations of the parliament.
Opening the joint session of the chambers of Parliament, Majilis Speaker Yerlan Koshanov said that there was only one issue on the agenda of the meeting – amendments and additions to the regulations of the Parliament of the Republic of Kazakhstan.
Chairman of the Committee on Legislation and Judicial and Legal Reform of the Majilis Arman Kozhakhmetov addressed the deputies.
He said that the joint commission working on amendments to the regulations received more than 50 proposals from deputies and committees.
“The amendments to the regulations proposed for consideration determine the procedure for implementing the provisions of the constitutional reform in our country,” he announced.
Kozhakhmetov informed that in connection with the amendment to the Constitution on the consideration of constitutional laws only at a joint session of the chambers of Parliament, it is proposed to fix this procedure in the rules of Parliament. It is proposed to supplement the Regulations with a new chapter 4-1, which is called “Adoption of constitutional laws”.
“Holding at least two readings on draft constitutional laws is mandatory. The draft constitutional law is submitted for registration to the Majilis. A copy of the bill is sent to the Senate for work no more than two days. To consider the draft constitutional law in the first reading, the chairman of the Mazhilis convenes a joint session of the chambers of parliament, at which the draft is discussed conceptually,” Kozhakhmetov said.
The initiator of the draft constitutional law will make the main report at the meeting, after which co-rapporteurs from each of the chambers will speak. The floor is also presented to the deputies of the Parliament in order of priority.
If necessary, a joint commission of the chambers of Parliament may be established to prepare a draft constitutional law for the second reading, the composition of which is approved at a joint meeting when considering the draft in the first reading. Also at this meeting, the chairman of the joint commission is elected and the terms of work of this commission are determined.
Before the second reading, the joint commission is working on reviewing and summarizing the comments and proposals of the Standing Committees and deputies on the draft constitutional law with the involvement, if necessary, of representatives of interested state bodies, public associations, scientists and experts.
According to Arman Kozhakhmetov, when considering the draft constitutional law in the second reading, in the case of the formation of a joint commission, the chairman of the joint commission acts. In the second reading, only those comments and proposals that were submitted by deputies and committees of the chambers in writing to the joint commission are subject to discussion.
According to the results of the voting, the Parliament, by a majority of at least 2/3 of the total number of deputies of each chamber, adopts a constitutional law or rejects it.
The next block of amendments, as reported by the head of the Committee on legislation and Judicial and legal reform of the Majilis, concerns the immediate consideration of government bills submitted to Parliament in accordance with part two of paragraph 2 of Article 61 of the Constitution.
We are talking about draft laws introduced as a legislative initiative of the Government in order to promptly respond to conditions that threaten the life and health of the population, the constitutional order, the protection of public order, and the economic security of the country.
The following procedure is proposed for the consideration of such “emergency” projects.
“The bill is registered in the Majilis. The Chairman of the Mazhilis convenes a joint session of the chambers of Parliament no later than the next working day after the day of the adoption of the bill. At a joint meeting, the Prime Minister makes a report, after which the floor is presented to the deputies for questions to the speaker and speeches in the debate,” Kozhakhmetov said.
If necessary, a joint commission of the chambers of Parliament may be formed to consider the bill, which will allow deputies to make their proposals and comments on the bill.
Based on the results of consideration, the draft law is adopted by a majority vote of the total number of deputies of each chamber.
If the specified number of votes is not obtained by voting, the draft law is considered rejected.
A separate chapter is proposed to reflect the procedure for Parliament to hear the report of the Prime Minister.
In accordance with subparagraph 4) of article 67 of the Constitution, the Prime Minister reports to Parliament on the main activities of the Government and on all its most important decisions.
It is proposed to hear this report at a joint session of the chambers of Parliament. At the same time, deputies have the right to ask questions and speak in debates when hearing the report of the head of the Cabinet of Ministers.
In order to bring in line with article 53 of the Constitution, a new chapter 4-3 on the procedure for consideration by Parliament of the President’s proposals on constitutional laws is being introduced into the Parliament’s regulations.
In addition, editorial and clarifying amendments have been made throughout the text of the Parliament’s regulations in order to bring them into line with the current legislative acts.
Arman Kozhakhmetov said that 7 meetings of the joint commission were held. As a result, the deputies voted for the adoption of the new regulations of the parliament. The supported amendments will take effect from January 1, 2023.
Recall that in March of this year, President of Kazakhstan Kassym-Jomart Tokayev presented a program of comprehensive modernization of the country’s political system. He noted that now the Senate has the right to adopt or not to adopt bills approved by the Majilis, that is, the Majilis actually has no possibility of overcoming the objections of the upper chamber. The Head of State proposed to introduce a norm that presupposes the right of the Senate only to approve or disapprove laws already adopted by the Majilis. Consequently, it is the Mazhilis that will receive the right to adopt laws. These amendments were made to the Constitution of Kazakhstan in a referendum on June 5.
